General Terms and conditions for using “My One” App

 

DEFINITIONS 

One Albania sha (hereinafter referred to as “One”) has developed the My One (AL) App (hereinafter referred to as “My One”) which enables the users to open an account and customize/connect this account to the One number, to get information on real time on his/her account and the bill, and top up the airtime credit, activate bundles, monitor the credit balance and its valid term, and access many more other services. This service is exclusively offered to the users of One network, whose application has already been approved beforehand by ONE.  

1. Acceptance of the Terms and Conditions

These general terms and conditions on the use of MY ONE App (hereinafter referred to as the “Agreement’) in their smartphone constitute the legal agreement between you and ONE (hereinafter collectively referred to as the “parties” and individually as “parties”).   

Before using this App by clicking the “I Accept” button, the user agrees herein below to act in compliance with the terms and conditions of this agreement and accepts and he/she has read, understood them and agrees to conform to all the terms, conditions and notifications contained in this agreement. If you do not agree to comply with the terms and conditions of this agreement, you may alternatively select the “Exit” button further below. 

ONE reserves the right to change, at any time and at its own discretion, the terms and conditions of this agreement, after a reasonable notification also concluding the release of a new version of the My One App. Any use thereafter of the My One App by the user implies acceptance of the terms and conditions of this agreement, with the relevant modifications.    

By consenting to this agreement, the user reserves the right to download and use all the services offered through My One App. Use of this application is offered free of charge to all the One users.  

The user declares that he/she has full and exclusive possession of his/her own One number.  

2. Usage rights 

ONE grants the user non-exclusive rights for using My One. The user unconditionally declares as follows:  

• Any information or service the users gets access to though this App, is only enabled to him/her for monitoring purposes.   

• The user is the sole responsible person for storing the usage codes, he/she is also responsible for all the actions performed by using the above mentioned codes and is therefore obliged to notify ONE on any unauthorized use or any possible security breaches (also including suspicions for security breaches). ONE does not undertake any legal responsibility or possible damage that may arise as a result of these actions, illegal an unauthorized use by third parties. ONE also reserves the right to claim compensation for any possible damages which arise from unauthorized or incorrect use by the user.  

• The users shall not copy, replicate, sell or get any possible commercial advantages whatsoever through this application. The users also agrees to refrain from transmitting any information, disclose to third parties or make public any data the user has gained access to by using the service and comply with all the relevant laws on information security, data protection and confidentiality.   

• ONE shall not be held responsible should any other unauthorized parties use the My One App or when it is affected by viruses. In any case ONE reserves the right to modify or temporarily or permanently terminate the service partly or fully, without a prior notification to the user. 

3. Users liability 

The user is fully liable for his/her actions with regard to the all types of content he/she downloads. By using this application, you accept that you shall only provide full and accurate information, when asked to do so.                   

In all other cases, general and special ONE User Agreements remain in full force and effect and the user declares that he/she is aware of and consents to them. 

4. Usage rules 

By using the My One application, the user undertakes:  

• Not to use the My One application for commercial ends. This application should only be used for personal purposes by the One customers and cannot be used for commercial purposes, unless this is clearly and expressly authorized in writing. 

• Unauthorized connections: if you wish to connect to the One network, you accept: a) not to replicate the My One application; b) not to perform actions relating or leading to uploads of misleading content about One on the website.   

5. Personal data usage rules 

The user grants One the right to use his/her personal data such as the phone number, his/her location through the GPRS system or information from his/her Facebook profile. These data are only used to provide up-to-date information on the user’s mobile number. 

The users of My One App shall be informed on the latest changes in the service bundles and the latest news on these services by customizing this information on the basis of the data received from the actions or information that the user himself/herself has introduced into the application. 

The user accepts that the information he/she has provided may be used for customizing the online ads through this App or other online channels. 

The personal data that you voluntarily declare to this moment shall be processed by applying with the highest security standards as required in the relevant legal provisions in force on personal data protection in Albania, as well as in the best international practices, exclusively to provide commercial products/services and/or to comply with any legal obligations that One may become subject to, on the basis of the legal and regulatory acts of the Republic of Albania. 

Information about you that we collect.

  1. Information that you provide directly, such as:
  • A number of our Services enable users to create accounts or profiles. For these Services, we may ask you to provide certain information about yourself, in order to set up your account or profile. For example, you can provide information about yourself, such as your name, date of birth and email address, when creating an account on My One.
  • If you order a product or service paid for by us, we will ask you for your name, contact details, shipping or billing address or addresses, and information about your credit/debit card, so that the partners, who we have entered into service contracts with and set clear rules for protection of personal data, can be able to process your order.

One Albania sha may receive information about you from third party social network services, when you choose to connect to those services.

  1. Other information we collect

One Albania sha may collect other information about you, your device, or your use of the Services, in such a way that we will describe it to you at the time of collection or in other ways with your consent. You may choose not to provide us with certain types of information, such as the information that One requires when registering an account with My One, but your refusal to give such information may affect your ability to use certain services.

Why do we use your personal information on My One App?

We will use the information we collect for the following purposes:

  • to register you or device to a Service;  
  • to offer you a Service or a functionality that you request;
  • to provide you with personalized content and services, referring to your previous activity our Services;
  • for evaluations and analysis of our market, customers, products and services (including cases in which we ask for your opinion about our products and services and when we conduct customer surveys;
  • to understand how people use our Services, in order for us to improve them and develop new products and services;
  • To offer maintenance services for your device and in other ways, provided that we have obtained your prior consent. 

When can I request to have my data deleted/destroyed?

The right to delete only applies in the following circumstances, i.e:

You have previously agreed to participate in a market research study and now you no longer wish to; The organization has collected or used your data illegally; Data protection rules have not been complied with; You have used social media or a gaming app and are under 18 years old.

How do I request to have my data deleted?

You should contact our One Albania Data Protection Officer via email and let him/her know what kind of personal data you want deleted. You can make your request by sending e-mail at dataprivacy@one.al or in writing to our HQs address:

We recommend that you follow up on your requests only in writing as this will allow you to explain your concern, give evidence and explain what you want to happen. You will also have clear evidence of your actions if you decide to challenge the organization's response.

6. Intellectual property rights 

Beside the registered brands, the service content (e.g.: brand, documents with information, etc.) also belongs to ONE and is protected by the Albanian copyright law and the international copyright laws. 

Provision by One of My One App does not imply any transferral of My One App’s intellectual property rights owned by One or the licensed providers, in line with its general terms and conditions. 

The content of this application is protected by the legislation in force on copyright and personal data protection. All rights are reserved.  

The user shall not change, copy or deploy the My One App partly. The users shall not transfer, reassign, deploy or allow a third party to use the My One App and none of the services offered through it. The user agrees not to use the My One App, its services or part of it. 

  

7. User safety accountability 

Users, above the age of 18 are held personally accountable for the obligations arising from use of the application. Users, under the age of 18, and the parent or legal custodian are accountable for the obligations arising from use of the application and the services offered through it.

8. Customer Care services 

The user may contact the Customer Care service on 142 (both prepaid and postpaid customers) and on 144 (corporate customers), for any enquiries you may have or information you may need with regard to the My One App, or simply log on to the official website www.one.al

9. Warranty disclaimer  

Insofar as the law in force permits the application does not offer any warranties or other conditions with regard to the application by licensed providers of the application. 

10. Applicable law and jurisdiction 

The Albanian law and/or the Personal Data Protection Law in force shall apply to these general terms and conditions on use of the application. The parties are subject to the exclusive jurisdiction of the Albanian courts.    

11. Miscellaneous 

The user agrees that the application may not be functional due to its incompatibility with the user’s handset. To use the application the user must have set up an internet connection in his/her handset. The user may contact the Customer Care team for information on the types of handsets that can be used to access the application.
